What is a probate? Administering an estate involves a variety of situations that must be handled through the court, whether or not the decedent had a will. Lunde Law Firm can assist you with:
  • Probate of Will: If a deceased person, called the decedent, left a will, the court must determine its validity. In the state of Arkansas, a will must be created by an individual who is 18-years-or-older and of sound mind. Holographic wills (handwritten with no witnesses) are also valid.
  • Estate Administration: Administering an estate involves a variety of situations that must be handled through the court, whether or not the decedent had a will. A personal representative will be appointed for the estate and will fulfill such duties as collecting appropriate assets, paying debts and taxes, and distributing the remaining property. We can help you with the estate's administration if your loved one did not leave a will and a personal representative needs to be assigned. 
  • Guardianship: When an individual is unable to care for herself or himself, the state of Arkansas allows a guardian to ensure that this person, called the ward, is safe and healthy. In addition to caring for the ward, the guardian must also report to the court and follow court-ordered instructions.
  • Will and Estate Contest and Litigation: If you believe that your late loved one did not name you as a beneficiary in a will as a result of undue influence, fraud or lack of testamentary capacity, it may be in your best interests to contest the will.
